These Terms of Service (“Terms”) govern your access to and use of the SoulSinq application and related services (the “Service”) provided by [OPERATOR: FULL LEGAL NAME], [POSTAL ADDRESS, COUNTRY] (“SoulSinq”, “we”, “us”). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree, you must not use the Service.
1. Eligibility
You must be at least 18 years of age to register for or use the Service. By using the Service, you represent and warrant that you are at least 18, have the legal capacity to enter into a binding contract, are not prohibited from using the Service under the laws of your jurisdiction, and have not previously been suspended or removed from the Service. We reserve the right to verify your age and identity and to suspend or terminate your account if we cannot do so or if you are found to be ineligible.
2. Account registration
You agree to provide accurate, current and complete information, to keep it up to date, to keep your login credentials confidential, and to notify us immediately at soulsinq@gmail.com if you suspect unauthorized access. You are responsible for activity under your account.
3. The Service - how SoulSinq works
3.1 Compatibility matching
SoulSinq matches users on compatibility scores derived from the profile and questionnaire answers you provide. Our algorithm is proprietary and continuously improved. Compatibility scores are informational tools, not predictions, and we do not guarantee that any match will result in a personal relationship.
3.2 Progressive photo reveal
Profile photographs are not visible to other users at the outset of a connection; they are disclosed progressively as two users interact, based on interaction milestones defined by us and subject to change. By using the Service you consent to your photos being stored and revealed to matched users through this progressive system, you understand the unlock thresholds may vary at our discretion, and you acknowledge that once a photo has been revealed to a matched user we cannot guarantee its removal from that user's device.
3.3 Communication and games
The Service enables text messages and voice notes between matched users, and shared in-app games whose answers are revealed to your match as part of play. You agree not to use these features to harass, threaten, deceive or harm other users. We do not read your conversations, with one exception: a conversation someone reports is read by a trained moderator to decide the report (see Section 5).
3.4 AI summaries
If you and another person have both turned them on, the Service can show a short summary of why you were suggested to each other, written by an AI service (Google Gemini). It is generated from the names of topics you share, it can be wrong, and it is not advice. You can report any summary from the app, which takes it down at once.
4. User conduct
There is no tolerance on SoulSinq for objectionable content or abusive users. We act on every breach: the content is removed from view, and the person who posted it is removed from the Service, or warned where a warning is enough for a first, minor breach.
You agree that you will not use the Service to:
- Post false, misleading or fraudulent profile information, or impersonate any person or entity.
- Upload photographs that do not depict you, are sexually explicit, contain nudity, depict minors, or are otherwise offensive or illegal.
- Send sexual content that the other person has not asked for, in a message, a voice note or a game.
- Post or send anything that sexualises a minor, or try to contact a minor for a sexual purpose. We report this to the authorities; see our Child Safety Standards.
- Harass, stalk, threaten, abuse or harm another user.
- Post hate speech: content attacking people for their race, ethnicity, religion, disability, gender, sexual orientation or any similar characteristic.
- Threaten or encourage violence, self-harm or terrorism.
- Offer, sell or ask for illegal goods or services, including drugs and weapons.
- Share another person's personal information, or a photograph revealed to you in the Service, outside it without their consent.
- Solicit money or financial assistance from other users.
- Promote commercial services, advertise, or spam.
- Transmit malware or code designed to disrupt or gain unauthorized access to our systems.
- Scrape or extract data from the Service with automated tools without our written permission.
- Violate applicable law.
Violation of this section may result in immediate suspension or termination of your account without refund.
5. Safety, reporting and moderation
- Every photograph you upload is automatically screened for adult, violent and sexually suggestive content. That screening is limited to those categories: it cannot tell whether a photograph actually depicts you. A photograph the automated check flags is not shown to anyone and is placed in a queue for a person to review. If that person confirms it breaks these Terms we refuse it and tell you why, naming the ground and stating that automated means were used to detect it. You can contest that decision by writing to soulsinq@gmail.com, where a person will look at it again and a different outcome is possible. We also act on photographs other users report to us.
- You can block anyone at any time, from a suggestion, from their profile or from the conversation - blocking immediately and permanently removes the match and its conversation for both sides.
- You can report anyone from the same places. Reports are reviewed by a person, normally within 24 hours: we remove the objectionable content and remove the user who posted it, or take a lighter step such as a warning where that is enough, and we let you know once a decision has been taken. A copy of your conversation with the person you report is kept with the report, so that it can still be reviewed after a block (the Privacy Policy says for how long).
- If we ban your account, we tell you why by email: the decision, the facts and the rule it rests on, and how to contest it. If we refuse one of your photos, the app tells you why, next to the photo. You can contest any decision within 6 months by writing to soulsinq@gmail.com; a person looks at it again. You can also turn to a certified out-of-court dispute settlement body under Article 21 of the EU Digital Services Act, or to the courts.
- We reserve the right to remove any content and to suspend or ban any account that endangers other users or violates these Terms.
6. Content and intellectual property
6.1 Your content
You retain ownership of the content you submit (profile information, messages, photographs - “User Content”). You grant SoulSinq a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to host, store, reproduce, modify (for technical purposes such as the blurred and tiled renderings), display and distribute your User Content solely as necessary to provide and improve the Service. You represent that you own or have the necessary rights to your User Content and that it infringes no third-party rights.
6.2 Our intellectual property
All other aspects of the Service - the SoulSinq name, logo, trademarks, software, design and matching algorithm - are the exclusive property of SoulSinq's operator or its licensors. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.
7. Subscriptions and payments
Certain features may in the future require a paid subscription (“Premium Features”). If you purchase one: subscriptions are billed in advance on a recurring basis, auto-renew unless cancelled at least 24 hours before the renewal date through the applicable app store, and prices may change with reasonable advance notice. Purchases made through the Apple App Store or Google Play are governed by the store's payment terms, and refund requests must be directed to the store. Nothing in this section limits your statutory rights as a consumer.
8. Privacy
Your use of the Service is subject to our Privacy Policy, which describes what we collect and why, including the consent-based handling of sensitive answers.
9. Third-party services
The Service may integrate with or link to third-party services (e.g. sign-in providers). We are not responsible for their content, privacy practices or terms.
10. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Service will be uninterrupted or error-free, nor do we guarantee the accuracy of compatibility scores or that use of the Service will result in romantic connections. Always exercise caution when meeting someone in person for the first time.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SOULSINQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for intent or gross negligence, or injury to life, body or health.
12. Indemnification
You agree to indemnify and hold harmless SoulSinq and its affiliates, officers, directors, employees and agents from claims, damages and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms or of any third-party rights.
13. Termination
We may suspend or terminate your account for violation of these Terms (see Section 5). You may delete your account at any time in Settings - deletion is described in the Privacy Policy and on the account-deletion page. Provisions that by their nature should survive termination (ownership, disclaimers, limitation of liability, dispute resolution) survive.
14. Governing law and disputes
14.1 Governing law
These Terms are governed by the laws of [COUNTRY OF THE OPERATOR], without regard to conflict of law principles. If you are a consumer residing in the European Union, you additionally enjoy the protection of the mandatory provisions of the law of your country of residence, and nothing in these Terms deprives you of the right to bring proceedings before the courts of that country.
14.2 Informal resolution
Before filing a formal claim, please contact us at soulsinq@gmail.com - most concerns can be resolved informally within 30 days.
14.3 Arbitration (where permitted)
Where binding arbitration clauses are enforceable against you under your local law, disputes that cannot be resolved informally shall be resolved by binding arbitration under the rules of a recognized arbitration body, and you waive participation in class actions to the extent permitted. This section does not apply where it would be invalid under mandatory consumer law - in particular, EU consumers retain full access to their local courts.
14.4 Exceptions
Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.
15. Changes to these Terms
We may update these Terms; material changes will be communicated with at least 14 days' advance notice via email or in-app notification. Continued use after the effective date constitutes acceptance; if you do not agree, stop using the Service and delete your account.
16. Miscellaneous
These Terms and the Privacy Policy are the entire agreement between you and SoulSinq regarding the Service. If any provision is found invalid, the remainder continues in effect. Failure to enforce a provision is not a waiver. You may not assign your rights without our consent; we may assign ours freely. No third-party beneficiary rights are created.
